9月17日:アメリカ合衆国の憲法記念日

米国では、地域によって多少異なりますが、DC周辺では、 9 月の第1 月曜日のLabor Day (労働者の日) の祝日の翌日から新学期が始まりました。10月はHalloween(ハロウィン)で子ども達が盛り上がり、11月はThanksgiving (感謝祭)の祝日があり、12月はChristmas (クリスマス)の祝日がありと、街全体が華やいだ雰囲気に包まれていくので、米国の秋から冬にかけては一番楽しみな季節となります。

 

さて今回は9月にちなんで、米国公文書館のサイトから、アメリカ合衆国憲法についてご紹介したいと思います。アメリカ合衆国の憲法は、1787年9月17日に作成され、翌年1788年に発効されました。現在おいても、アメリカの法律の基本となっています。日本では、太平洋戦争終結から約2年後の、1947年(昭和22年)5月3日に日本国憲法が施行されたことを記念して、5月3日は憲法記念日となり、祝日の一つとなっています。しかしながら、米国では、憲法記念日は祝日ではありませんし、多くの米国人もそうした憲法が作成された日については知らないようです。米国人に聞くと、一番大事な記念日は、やはり7月4日の独立記念日だそうです。

上記の資料は、

 

“We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”

(われら合衆国の国民は、より完全な連邦を形成し、正義を樹立し、国内の平穏を保証し、共同の防衛に備え、一般の福祉を増進し、われらをわれらの子孫のために自由の恵沢を確保する目的をもって、ここにアメリカ合衆国のためにこの憲法を制定し、確定する。)

 

という前文から始まる合衆国憲法です。

 

この前文のあとに、本文の7条(1. 議会、2. 大統領、3.司法、4.州と連邦政府、5.憲法の修正、6.最高法規としての憲法、7.憲法の批准)が続き、さらに1から27条までの修正条項が続きます。

上記の資料は、憲法の修正事項の最初の10カ条を権利章典として国民の基本的人権に関するものをまとめたものです。1789年に連邦議会から提案された修正事項は当初は12の修正条項がありましたが、1791年にそのうちの10カ条が批准されて憲法に追加された形となりました。
